These Terms of Service ("Terms") govern your access to and use of the atomicOS iOS application and its related in-app and server-side features (collectively, the "Service").
By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
If you downloaded the app from the Apple App Store, your use of the app may also be subject to Apple's applicable terms and platform rules.
1. Eligibility
You may use the Service only if you are legally permitted to do so under applicable law. If you use the Service on behalf of an organization or another person, you represent that you have the authority to do so.
2. Description of the Service
atomicOS is a running and personal health data analysis tool. The Service may allow you to:
- sign in with your Apple Account
- authorize atomicOS to read eligible workout, activity, and body data from Apple Health / HealthKit
- view your running history, weekly training trends, and single-activity details
- view route maps, kilometer splits, heart rate / pace / power zones, elevation, and derived performance metrics
- view body metrics such as VO₂ max, heart rate variability, resting heart rate, and sleep, together with recovery and readiness indicators
- maintain personal ability baselines such as maximum heart rate, threshold pace, and running functional threshold power
- manage running equipment and associate equipment with specific activities
- receive personalized training insights generated from structured workout, body, weather, and location data
- switch the interface language, sync your settings, sign out, or delete your account
- contact support by email
Available features may differ by app version, region, device, iOS version, and the permissions you grant.
3. Account and Sign in with Apple
Signing in with your Apple Account is required to use the Service.
When you sign in, we create an account record identified by an internal user identifier so that your profile, ability baselines, equipment, and settings can be synced. Sign in with Apple is operated by Apple and is subject to Apple's terms and privacy policy, including Apple's private email relay if you choose to hide your email address.
You are responsible for maintaining the security of the Apple Account you use to access the Service, and for activity that occurs through your account.
4. Health and Fitness Data Authorization
Most features require access to health, fitness, workout, or route data that you choose to authorize through Apple Health / HealthKit.
By granting authorization, you acknowledge and agree that:
- you control whether to grant, deny, or revoke each category of permission;
- atomicOS can only access the categories of data you expressly authorize;
- if you revoke authorization, some features may stop working, become limited, or show incomplete results;
- Apple Health, HealthKit, WeatherKit, and other connected services may change their APIs, terms, privacy policies, or technical limits at any time;
- analysis quality depends on the completeness and accuracy of the data recorded by your devices, which we do not control.
HealthKit data may not be used for advertising, marketing, or similar prohibited purposes, and atomicOS is intended to comply with those restrictions.
5. Read-Only Use of Health Data
atomicOS requests read-only access to authorized workout and body data in order to provide analysis and visualization directly to you.
The Service does not write workout or health data back to HealthKit, and it is not intended to write false or inaccurate health data.
6. Location and Weather
If you grant location permission, the Service may use your current location and city information to retrieve weather data through Apple WeatherKit and to provide environmental context for activity details and training insights.
Location and weather features are optional. If you deny or revoke location permission, related content may be unavailable or incomplete. Weather information is provided by third-party sources and may be delayed, approximate, or inaccurate, and must not be relied on for safety decisions.
7. Photos, Camera, and Equipment Content
If you choose to add an image to a piece of equipment, the Service may request access to your camera or photo library for that purpose.
You retain ownership of the images and other content you add. You are responsible for ensuring that content you add:
- is lawful;
- does not violate third-party rights;
- is not misleading, fraudulent, defamatory, abusive, or infringing.
8. Personal Baselines and Settings
Features such as heart rate zones, pace zones, power zones, training load, and readiness depend on the ability baselines and profile information you provide, including maximum heart rate, threshold pace, running functional threshold power, height, weight, date of birth, and sex.
You are responsible for the accuracy of the information you enter. Incorrect baselines will produce incorrect zones, load values, and derived analysis.
9. Training Insights and Generated Content
The Service can generate written training insights, daily status notes, activity recaps, and recovery-related content. To do so, the app organizes structured workout, body, weather, and location data and sends it to our servers, where it may be processed with the help of third-party AI model providers under contract, and the resulting text is streamed back to your device.
Generated content:
- is produced automatically and may be incomplete, inaccurate, outdated, or inconsistent;
- is provided for general informational and reflective purposes only;
- is not a professional assessment of your health, fitness, or training readiness;
- must not be relied on as a substitute for professional medical, health, coaching, or safety advice.
You are solely responsible for how you act on generated content, including any decision to train, rest, increase load, or seek medical attention.
10. No Medical, Coaching, or Safety Advice
atomicOS is provided for informational, analytical, and personal fitness-tracking purposes only.
The Service is not a medical device and does not provide medical advice, diagnosis, treatment, emergency assistance, or guaranteed coaching or performance outcomes.
Any metrics, zones, trends, training load values, readiness or recovery indicators, classifications, and insights generated by the Service are for general informational purposes only. Always consult a qualified professional regarding your health, symptoms, injuries, medication, or training program, and seek immediate medical attention in an emergency.
11. Acceptable Use
You agree not to:
- use the Service in violation of any applicable law or regulation;
- access or attempt to access data or accounts you are not authorized to access;
- interfere with, disrupt, reverse engineer, decompile, or compromise the Service, its APIs, its request signing or security mechanisms, or its infrastructure, except as permitted by law;
- use automated means to access the Service in a way that imposes unreasonable load, or attempt to circumvent rate limits;
- upload malware or harmful code;
- misuse connected services or exceed their permitted use;
- use the Service to fabricate, falsify, or fraudulently misrepresent activity records or performance;
- resell, sublicense, or commercially exploit the Service or its generated output without our written permission.
We may suspend or limit access to the Service if we reasonably believe that your use violates these Terms or applicable law, or creates risk to the Service or others.
12. Third-Party Services
The Service integrates with third-party services and Apple frameworks, including Apple Health / HealthKit, Apple Watch, Sign in with Apple, Apple Maps / MapKit, Apple WeatherKit, Photos, Mail, system sharing features, Mapbox map rendering, and third-party AI model providers used to generate insights.
We are not responsible for the availability, policies, acts, omissions, downtime, API changes, account restrictions, or content of third-party services.
Your use of any third-party service is governed by the terms and privacy policy of that third party.
13. Intellectual Property
The Service, including its software, algorithms, interface design, branding, text, graphics, charts, layout, and non-user-owned visual elements, is owned by or licensed to atomicOS / Atomic OS and is protected by applicable intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.
You may not copy, modify, distribute, sell, sublicense, or exploit any part of the Service except as expressly permitted by these Terms or applicable law.
14. Privacy
Your use of the Service is also governed by the Privacy Policy, which explains how the Service accesses, uses, stores, transmits, and retains information.
Where Apple Health / HealthKit data is involved, the Service is intended to handle such data in accordance with applicable law, Apple's platform rules, and the Privacy Policy.
15. Service Availability and Changes
We may modify, suspend, discontinue, or update any part of the Service at any time, including its features, integrations, technical requirements, supported data sources, analysis methods, and user interface.
We do not guarantee that the Service, or any feature, will always be available, uninterrupted, secure, accurate, or error-free. Server-dependent features such as sign-in, settings sync, weather, and training insights require an internet connection.
16. Beta, Preview, or Experimental Features
The Service may include beta, preview, experimental, or early-access features. Those features may be incomplete, unstable, unavailable in some regions, or changed or removed at any time without notice.
17. Fees
The Service is currently provided without charge. We may introduce paid features, subscriptions, or usage limits in the future. Any paid feature will be clearly identified before purchase, and purchases made through the App Store are subject to Apple's payment, refund, and subscription rules.
18. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND ERROR-FREE OPERATION.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
- THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE;
- ANY DATA, METRICS, ZONES, ROUTES, TRAINING LOAD VALUES, RECOVERY INDICATORS, CLASSIFICATIONS, VISUALIZATIONS, OR INSIGHTS WILL BE ACCURATE OR COMPLETE;
- ANY GENERATED OUTPUT WILL MEET YOUR EXPECTATIONS OR BE SUITABLE FOR ANY TRAINING, HEALTH, OR SAFETY DECISION;
- ANY THIRD-PARTY INTEGRATION WILL REMAIN AVAILABLE;
- ANY HISTORICAL OR ACTIVITY DATA WILL CONTINUE TO BE ACCESSIBLE, SYNCHRONIZED, OR PRESERVED.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATOMICOS / ATOMIC OS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, BUSINESS, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING ANY TRAINING, HEALTH, OR SAFETY DECISION MADE IN RELIANCE ON THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID TO US, IF ANY, FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE; OR
- USD $50.
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.
20. Termination and Account Deletion
You may stop using the Service at any time. You may sign out, or delete your account from within the app, which removes your account profile and associated synced data as described in the Privacy Policy.
We may suspend or terminate access to the Service at any time if we reasonably believe that you violated these Terms, created legal exposure, harmed other users, or threatened the security or integrity of the Service.
Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, and indemnity-related obligations.
21. Governing Law and Disputes
To the extent permitted by applicable law, these Terms are governed by the laws applicable in the jurisdiction where the operator of the Service is established, without regard to conflict-of-law rules.
If a dispute cannot be resolved informally, it will be subject to the courts that otherwise have lawful jurisdiction over the matter, except to the extent that mandatory consumer protection law provides otherwise.
22. Changes to These Terms
We may update these Terms from time to time to reflect product, legal, or operational changes. If we do, we will update the Effective Date and Last Updated date above.
Your continued use of the Service after revised Terms become effective means you accept the updated Terms.
